Pre Charge Decision Request

MG03 – Pre-Charge Decision Request is used by an investigator to refer a case to the CPS for charging advice or a charging decision. It summarises the key evidence, legal and evidential issues, outstanding enquiries and the proposed approach. It is signed by a supervisor and is not itself a charge.

Additional guidance

MG03 is used when police need the CPS to advise on, or decide, whether a suspect should be charged. The investigator completes the form and a supervisor signs it before the referral is sent through the relevant police/CPS case management process.

The request should provide the CPS with a clear, balanced summary of the case, including:

  • the suspect and proposed offence or offences;
  • a factual summary and key evidence;
  • key witnesses, victims, exhibits and interview material;
  • reasonable lines of enquiry completed, outstanding or not pursued;
  • issues such as bail, remand, special measures, bad character or safeguarding;
  • why the investigator considers the relevant charging test is met; and
  • contact details for the investigator and supervisor.

MG03 does not charge the suspect or guarantee a prosecution. It enables the CPS to decide whether the evidential and public interest requirements for charge are met, or to give further advice about the investigation.
