MG03A – Further Report to CPS for Charging Decision is used to provide the CPS with further information after it has asked for clarification or additional investigative work on a pre-charge referral. It records what has been done in response and supports the CPS’s further charging advice or decision. It is not a charge.

Additional guidance

MG03A is a follow up form in the pre-charge decision process. It is used after police have submitted an MG03 and the CPS has issued an action plan or requested further information.

The investigator uses MG03A to report back to the CPS on:

  • additional enquiries completed;
  • further evidence obtained or reviewed;
  • clarification of facts, legal issues or the proposed offence;
  • outstanding reasonable lines of enquiry and expected completion dates;
  • new information about victims, witnesses, safeguarding, bail, special measures or disclosure; and
  • any change affecting the charging decision.

The supervising officer must sign the form before it is returned to the CPS. The CPS lawyer then records further advice or a charging decision.

MG03A does not charge a suspect and does not guarantee that the CPS will authorise a charge. It enables the CPS to assess whether the further work addresses the issues previously identified and whether the charging test is now met.

Relationship to MG03: MG03 is the initial referral to the CPS for charging advice or a decision. MG03A is used later, when the CPS needs more information or further action before giving further advice or deciding whether to charge.
