About these Terms

These Terms of Use govern your use of Criminal Justice Hub (“CJH”), including our website, mobile application, member accounts, tools, directories, comments, feedback and other interactive features.

Conviction operates CJH. Criminal Justice Hub is a Conviction project and public facing service; it is not a separate legal entity.

By using CJH, you agree to these Terms. If you do not agree, do not create an account or use CJH’s interactive features.

These Terms do not limit any right that cannot lawfully be limited. If you are a consumer, nothing in these Terms affects your mandatory statutory rights.

What CJH provides – and what it does not

CJH provides general criminal justice information and reference resources. It may include articles, directories, forms, calculators, maps, policy collections, offence data and links to other organisations.

CJH does not provide legal advice, representation, casework, medical advice, emergency support, or an official statement on behalf of a court, police force, prison, probation service, government body or other organisation unless we expressly say otherwise.

Using CJH does not create a solicitor client, barrister client, adviser client, fiduciary or other professional relationship with Conviction or any contributor.

Laws, procedures, policies and local practices change. Check the date of any material, read the linked primary or official source, and obtain advice from an appropriately qualified professional about your individual circumstances. Do not rely on CJH as the sole basis for making a legal, professional, medical, financial, safeguarding, detention, release, travel, housing, employment or deadline related decision.

CJH is not an emergency service. If there is immediate danger, call 999. For an urgent concern about a prisoner’s safety, contact the relevant prison directly or use an appropriate emergency or safeguarding route.

Reference tools and calculators

CJH tools and calculators are for general reference only. Any output is an estimate or aid to understanding, not a decision, instruction or confirmation of legal status.

In particular, release date or sentence related tools may not account for every sentence, offence, exception, transition, appeal, recall, licence condition, concurrent or consecutive term, data error, policy change or change in law. You are responsible for checking the inputs, dates, scope limits, sources and results against authoritative information.

We may change, suspend or remove a tool where reasonably necessary for security, legal, safeguarding, accuracy, operational or service improvement reasons.

Accounts

You must provide accurate, current information when creating an account and keep it updated. You must keep your password confidential, use a unique password and tell us promptly if you believe someone has accessed your account without permission.

We may require email verification before an account can be used. Accounts using approved professional or government email domains may be approved automatically after verification. Other accounts require manual review.

You must not:

  • create an account using false or misleading information;

  • use another person’s account or allow another person to use yours;

  • impersonate a person or organisation;

  • try to obtain access to restricted parts of CJH without permission; or

  • use an account for unlawful, abusive, commercial spam or deceptive activity.

We may refuse, limit, suspend or close an account where reasonably necessary to protect people, enforce these Terms, investigate misuse, respond to a safeguarding concern, comply with law, protect the security or integrity of CJH, or maintain the service. We will act fairly and proportionately and, where appropriate, explain our decision.

You are responsible for activity through your account unless it results from our failure to use reasonable care and skill.

Children and young people

CJH information pages may be used by children and young people. Member accounts and public contributions are not intended for children under 13.

If you are under 18, speak to a parent, carer or other responsible adult before creating an account or submitting a public contribution. Do not post personal, case, safeguarding or sensitive information about yourself or anyone else.

A child, parent, carer or responsible adult may contact us to ask for content to be reviewed or removed, or to raise a safeguarding concern.

Acceptable use

You must use CJH lawfully, responsibly and in a way that does not harm other people, CJH or its systems.

You must not:

  • bypass or attempt to bypass security, access controls, rate limits, account approval or technical restrictions;

  • test, scan, probe or exploit a vulnerability without our prior written permission;

  • introduce malware, ransomware, spyware, viruses, harmful code or other material that may damage, disrupt or interfere with CJH or another person’s systems;

  • use automated means, scraping, harvesting or bulk extraction in a way that is excessive, harmful, commercial, or contrary to our technical controls, intellectual property rights or data protection obligations;

  • collect, publish, sell, disclose or misuse another person’s personal information;

  • interfere with the availability, integrity or security of CJH;

  • use CJH for fraud, harassment, abuse, threats, discrimination, incitement of violence, illegal activity or any other unlawful purpose; or

  • use CJH in a way that could damage Conviction’s reputation, systems, users or lawful operations.

Normal search engine indexing and reasonable non commercial accessibility, educational or research use are permitted where they respect these Terms, technical controls, intellectual property rights and data protection law.

Comments, feedback and other contributions

You remain responsible for the content you submit to CJH, including comments, feedback, reports and other contributions.

All public comments and contributions are subject to pre publication moderation. We do not have to publish any contribution.

You must not submit content that:

  • is false, misleading, defamatory, discriminatory, threatening, abusive, harassing, hateful, obscene or otherwise unlawful;

  • identifies, or may identify, a child, victim, witness, prisoner, suspect or another vulnerable person where this could cause harm, breach a legal restriction or intrude on privacy;

  • contains confidential case information, disclosure material, legal advice, prison security information, police intelligence, medical or health information, private addresses or contact details, or another person’s sensitive information without a lawful and necessary reason;

  • asserts or implies that an identifiable person committed an offence, engaged in misconduct or is under investigation, unless publication is demonstrably lawful and appropriate;

  • risks breaching a reporting restriction, anonymity order, youth justice restriction, contempt of court rule or other legal duty;

  • infringes intellectual property, privacy, data protection or other rights;

  • promotes self harm, violence, terrorism, hatred, fraud, evasion of lawful criminal justice controls, malware, spam, commercial advertising or illegal activity; or

  • contains personal data that is unnecessary for the purpose of the contribution.

We may reject, edit for clarity, privacy or accessibility, redact, remove, restrict, anonymise or retain content where reasonably necessary to protect people, comply with law, respond to a complaint, manage a safeguarding concern, investigate misuse, protect CJH, or preserve evidence for a legal claim, investigation or legal obligation.

Automated security and spam detection measures may identify suspicious activity or content for human review. We do not make decisions with legal or similarly significant effects solely by automated means.

Reporting content and concerns

You can report inaccurate, unlawful, harmful, unsafe or rights infringing content, including a safeguarding concern, personal information concern, copyright complaint, suspected security vulnerability or accessibility barrier.

Email [email protected] with:

  • the page address or sufficient details to identify the material;

  • a clear explanation of the concern;

  • any relevant supporting information; and

  • a safe way for us to contact you.

If you believe content is defamatory, explain the statement complained of, why it concerns you, where it appears and why you say it is defamatory. We may request further information necessary to assess and respond to the report.

Do not publicly disclose a suspected security vulnerability before giving us a reasonable opportunity to investigate it. This does not prevent you from reporting a matter to a regulator, law enforcement body or other authority where appropriate.

For immediate danger or an urgent safeguarding risk, call 999 or contact the appropriate emergency, safeguarding or criminal justice service. Do not rely on CJH comments, feedback forms or email for an emergency response.

Licence to use your content

You keep ownership of the intellectual property rights you hold in content you submit. By submitting content, you give Conviction a worldwide, non exclusive, royalty free licence to host, store, reproduce, format, moderate, display, communicate, adapt for accessibility and publish that content to operate, secure, maintain and archive CJH.

We will not use a public contribution in separate promotional material unless it is anonymised, you have agreed, or the reuse is otherwise lawful and fair in the circumstances.

This licence ends when your content is deleted from CJH, except to the extent that we need to retain a copy for backups, complaints, legal claims, safeguarding, security, legal obligations, or because it has already been lawfully shared or archived.

You promise that you have the necessary rights and permissions to submit the content and grant this licence.

Intellectual property

CJH’s design, branding, original text, graphics, tools and other original content are owned by Conviction or its licensors unless a page states otherwise.

You may view, print, download for personal use and share links to CJH for personal, educational and professional reference. You must not reproduce, republish, adapt, distribute or commercially exploit a substantial part of CJH’s original content without our permission, except where the law allows it.

You must not use Conviction’s or CJH’s name, logo or branding in a way that suggests endorsement, affiliation or approval without written permission.

Some material may belong to a third party, be Crown copyright, be available under the Open Government Licence, or be subject to another stated licence. You must comply with the licence and terms that apply to that material. A link to, or inclusion of, third party material does not transfer ownership or grant you additional rights.

Third party links and services

CJH may link to, embed or use information from third party websites and services. We do not control those third parties and are not responsible for their content, availability, security, terms or privacy practices.

A link, reference or inclusion does not mean that Conviction endorses a third party, its views, products, services or information. You use third party sites and services at your own risk and should read their terms and privacy information.

Privacy and cookies

Our Privacy Policy explains how Conviction collects, uses, shares, retains and protects personal information. Our Cookie Notice explains cookies, optional analytics, embedded media and how you can manage your choices.

By using CJH, you must not provide us with personal information about another person unless you have a lawful basis to do so and have provided any information or obtained any consent required by law.

Availability, changes and suspension

We aim to keep CJH available, accurate and secure, but we do not guarantee that it will always be available, uninterrupted, error free, complete or up to date.

We may change, update, suspend, withdraw or restrict all or part of CJH where reasonably necessary for security, maintenance, legal compliance, safeguarding, accuracy, operational or service improvement reasons. Where reasonably practicable, we will give notice of a material planned interruption.

Our responsibility to you

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory rights that apply to you as a consumer.

CJH is a free general information service. Subject to the paragraph above, we are not liable for loss or damage arising from:

  • reliance on CJH’s general information, tools, calculators, directories, maps, external links or third party content instead of obtaining appropriate professional advice or checking authoritative sources;

  • inaccurate, incomplete or unlawful information submitted by a user or third party;

  • an error in information you provide, an unauthorised use of your account for which we have not failed to use reasonable care and skill, or your failure to protect account credentials;

  • loss that was not reasonably foreseeable when you used CJH; or

  • a temporary interruption, delay, technical fault or unavailability of CJH where we have taken reasonable care.

If you use CJH for business, trade or professional purposes, we exclude liability to the fullest extent permitted by law for loss of profit, revenue, business, opportunity, goodwill, anticipated savings, data, or indirect or consequential loss.

We do not seek to apply a fixed financial cap to a consumer claim where doing so would be unfair or contrary to mandatory law. Any separate written agreement for a paid or commissioned service will govern liability for that service.

Changes to these Terms

We may update these Terms where reasonably necessary because of changes to law, security, safeguarding, CJH’s services, technology or operations.

We will publish the updated Terms with a new “Last updated” date. Where a change is material, we will take reasonable steps to draw it to users’ attention before it takes effect where practicable.

If you continue to use CJH after updated Terms take effect, you will be treated as accepting them, unless mandatory law provides otherwise. If you do not agree with the updated Terms, stop using interactive features and close your account if you have one.

Governing law and jurisdiction

These Terms and any non contractual obligations arising from or connected with them are governed by the law of England and Wales.

The courts of England and Wales have non exclusive jurisdiction. If you are a consumer, you keep any mandatory right to bring proceedings in another court where applicable law gives you that right.

Other important terms

If a court or competent authority finds a provision of these Terms unlawful, invalid or unenforceable, that provision will be treated as removed only to the necessary extent. The rest of these Terms will continue to apply.

A delay or failure by Conviction to enforce a provision is not a waiver of that provision or any other right.

No person other than you and Conviction has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999, except where the law gives them a right independently.
