Additional guidance
MG04A is used to record when a person is granted conditional bail by police and when those conditions are later changed.
It should record:
- that conditional bail has been granted;
- the specific conditions imposed;
- why each condition is considered necessary; and
- any later variation, removal or addition of conditions.
MG04A is distinct from MG04 – Charge Sheet, which records the offence charged, the defendant’s response and any unconditional bail granted after charge. MG04A records conditional bail and changes to the conditions.
It is also different from court bail. If someone has already attended court and is on court bail, changes to their conditions must be sought from the court, not through the police MG04A process.
Bail conditions can restrict where a person lives or goes, who they contact, whether they report to police, or whether they surrender travel documents. A person should read the bail notice carefully, keep a copy and obtain legal advice promptly if they do not understand the conditions or need a change.
The current public reference is the Home Office criminal casefile and MG-form guidance. Further information about the distinction between police and court bail is available in the CPS bail guidance.
